Favourable outcome in the Court of Appeal in the matter of the Competition Authority vs. Síminn hf.

The case concerned the Competition Authority‘s decision to fine Síminn ISK 500 million for allegedly infringing commitments imposed on Síminn by previous settlements with the Competition Authority, through its sales of subscriptions to the English Premier League in Iceland.

By its judgment of 16 February 2024 in case no. 674/2022, the Court of Appeal upheld the judgment of the District Court to overturn a decision of the Icelandic Competition Authority.

The case concerned the Competition Authority‘s decision to fine Síminn ISK 500 million for allegedly infringing commitments imposed on Síminn by previous settlements with the Competition Authority, through its sales of subscriptions to the English Premier League in Iceland.

The Court of Appeal agreed with the District Court in finding that the Competition Authority had not demonstrated that Síminn had infringed the commitments.

The Icelandic state was ordered to repay the fine, which the competition appeals committee had previously lowered to ISK 200 million, in addition to ISK five million in costs.
